Warranty Conditions of Phönix Handels GmbH – Long-Term Warranty 36 Months

§ 1 Warranty Provider

§ 2 Relationship to statutory warranty rights

(1) The following long-term warranty is a voluntary, additional service of Phönix Handels GmbH.

(2) Your statutory rights in case of defects, in particular your statutory rights against us as the seller, remain unaffected by this. The exercise of these rights is free of charge for you.

(3) The long-term warranty does not restrict or replace your statutory rights.


§ 3 Scope of Application

(1) These warranty conditions apply to products that are explicitly marked with "36 Months Long-Term Warranty" in our online shop and for which you have selected the corresponding warranty option for a fee during the ordering process.

(2) The booked warranty option is explicitly stated on the invoice or order confirmation.

(3) If no warranty option is selected, no claims arise from the following long-term warranty; your statutory warranty rights remain unaffected.

(4) The warranty applies exclusively to consumers within the meaning of § 13 BGB as original buyers of the goods who purchase the item for private purposes.

(5) The warranty applies to corresponding products regardless of whether they are offered under the brand "Phönix Germany" or under another brand. In all cases, the warranty provider is Phönix Handels GmbH.

(6) The territorial scope of the warranty is the European Union, limited to certain member states where Gasland24 sells and delivers the respective item.

(7) Only new goods purchased through the Gasland24 online shop are eligible for warranty.


§ 4 Definition and Duration of the Long-Term Warranty

(1) The designation "36 Months Long-Term Warranty" means that Phönix Handels GmbH offers a warranty protection of a total of up to 36 months from the invoice date for the appropriately marked item – in addition to your statutory warranty rights – provided that the warranty option has been effectively concluded.

(2) The long-term warranty in the narrower sense extends for the period from the expiry of 24 months to the expiry of 36 months from the invoice date ("third year").


§ 5 Guaranteed Quality

Phönix Handels GmbH provides a durability guarantee for the items covered by these conditions, stating that the respective item will remain free from material and manufacturing defects during the warranty period, provided it is used as intended and for private purposes.
The warranty only covers defects that are due to material or manufacturing defects.
Not covered are, in particular, damages or defects caused by wear and tear, improper use, external influences, or other exclusion reasons mentioned in § 8.


§ 6 Warranty Services in the Third Year

(1) If a defect occurs within the period from the expiry of 24 months to the expiry of 36 months from the invoice date, which falls under these warranty conditions and is not excluded according to § 8, a warranty case exists.

(2) In the event of a warranty claim, Phönix Handels GmbH will primarily attempt to repair the item.

(3) If a repair is not possible or not economically reasonable in our reasonable estimation, Phönix Handels GmbH may, at its discretion,

  • Supply an equivalent replacement item (new or refurbished) or
  • a financial compensation according to paragraph 4.

(4) If the delivery of a replacement item is also not possible or economically unreasonable, we will grant financial compensation. In the third year, this is limited to a maximum of 70% of the actual purchase price paid. The specific amount will be determined taking into account the age, condition, and previous use of the item.

(5) Financial compensation will be made simultaneously with the return and transfer of ownership of the defective item.

(6) After the warranty service has been rendered, the warranty period does not restart.


§ 7 Procedure for Asserting the Warranty

(1) A warranty case must be reported immediately after discovery of the defect within the warranty period.

(3) Please have the following information ready:

  • Name and contact details
  • Order number / Invoice number
  • Item description
  • (Serial number)
  • Description of the defect
  • Meaningful photos or videos if possible

(4) After receipt of your report, we will inform you of the further procedure. Depending on the product and defect, the warranty service will be provided by sending in, collecting, on-site repair, replacement delivery or financial compensation.

(5) In the event of an approved warranty claim, we will cover the reasonable transport costs within the territorial scope.

(6) If there is no warranty case, in particular due to an exclusion reason according to § 8, we may charge the reasonable transport, inspection and return costs.


§ 8 Exclusions

The warranty specifically excludes:

  • Consumables and wear parts, e.g. seals, filters, ignition parts, nozzles, lamps, batteries, rechargeable batteries, and similar parts whose wear corresponds to normal use
  • Accessories, spare parts, and freebies, unless they are explicitly marked as covered by the warranty
  • Damage due to improper or non-intended use
  • Damage due to non-observance of assembly, installation, operating or care instructions
  • Mechanical damage, in particular fall, impact or breakage damage
  • Damage due to external influences such as fire, water, moisture, corrosion, overvoltage, lightning, extraordinary environmental conditions or force majeure
  • Damage caused by unauthorized repairs, modifications or other interventions by unauthorized persons
  • Damage caused by operation with unsuitable fuels, gases or operating materials
  • commercial or otherwise non-household use
  • Software errors, data loss and viruses, if applicable

Normal signs of use do not constitute a warranty case.


§ 9 Non-transferability

(1) The warranty is non-transferable and applies exclusively to the first purchaser who purchased the item via the Gasland24 online shop and booked the warranty option.

(2) In the event of resale, gifting or other transfer of the item, the rights under this warranty are not transferred to the acquirer or other third parties.

(3) To claim the warranty, proof of the original purchase and the booking of the warranty option, in particular by invoice or order confirmation, must be submitted.


§ 10 Applicable Law

The law of the Federal Republic of Germany applies. Mandatory consumer protection regulations of the state in which you have your habitual residence remain unaffected.
